These Terms and Conditions, together with any other documents referred to herein, set out the terms of use governing your use of the website, https://hampshirearchivestrust.co.uk (“the HAT Website”).

Please read these Terms and Conditions carefully before using the HAT Website. Your use of the HAT Website indicates your agreement to comply with these Terms and Conditions. If you do not agree, you must stop using the HAT Website immediately.

The following documents also apply to your use of the HAT Website: our Privacy Policy and our Cookie Policy.

Definitions and Interpretation

In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

  • “Content”means any and all text, images, audio, video, scripts, code, software, databases, and any other form of information capable of being stored on a computer that appears on, or forms part of, the HAT Website.
  • “HAT”means Hampshire Archives Trust.

Information About HAT

  • The HAT Website is operated by HAT.
  • HAT is a registered charity, number 294312.
  • HAT’s registered address is c/o Hampshire Records Office, Sussex Street, Winchester SO23 8TH.

Membership and Subscriptions

  • HAT offers paid membership subscriptions via the HAT Website. By purchasing a membership, you agree to the terms set out in this Part 3.
  • Memberships are offered on an annual recurring basis. Unless you cancel your membership before your renewal date, your membership will automatically renew each year and the applicable membership fee will be charged to your payment method.
  • You will receive advance notice of your upcoming renewal by email. HAT will send a reminder approximately 30 days before your renewal date and again approximately 7 days before your renewal date. These reminders will include clear instructions on how to cancel your membership before it renews.
  • You may cancel your membership at any time before your renewal date by following the instructions provided in your renewal reminder emails, or by contacting HAT at hat@hampshirearchivestrust.co.uk. Cancellation will take effect at the end of your current membership period and no further payments will be taken.
  • Membership fees are non-refundable except at HAT’s discretion or where required by law. If you believe a payment has been taken in error, please contact HAT as soon as possible.
  • HAT reserves the right to change membership fees. You will be notified of any change in advance of your renewal date, giving you the opportunity to cancel before the new fee is applied.
  • By purchasing a membership, you confirm that you have read and agree to these Terms and Conditions, including the recurring payment terms set out in this Part 3.

Gifted memberships: Where a membership is purchased as a gift, it is valid for one membership period only and will not renew automatically. The recipient will be notified when their gifted membership is due to expire and may choose to take out their own membership at that point. No further payment will be taken from the gift purchaser after the initial transaction.

Access to the HAT Website

  • Access to the HAT Website is without cost to you.
  • It is your responsibility to make the arrangements necessary in order to access the HAT Website.
  • Access to the HAT Website is provided on an “as is” and “as available” basis. HAT may suspend or discontinue the HAT Website (or any part of it) at any time.
  • HAT does not guarantee that the HAT Website will always be available or that access to it will be uninterrupted.

Changes to the HAT Website

HAT may alter and update the HAT Website (or any part of it) at any time.

Changes to These Terms and Conditions

  • HAT may alter these Terms and Conditions at any time. If HAT does so, details of the changes will be highlighted at the top of this page.
  • Your continued use of the HAT Website following any changes constitutes your acceptance of the updated Terms and Conditions. You are therefore advised to check this page each time you use the HAT Website.
  • If any part of the current version of these Terms and Conditions conflicts with any previous version, the current version shall prevail unless HAT explicitly states otherwise.

International Users

While the HAT Website is available to persons or entities outside the United Kingdom, HAT does not warrant or represent that the HAT Website or its Content are available in other locations or are suitable for use outside the United Kingdom.

Intellectual Property Rights

  • All Content included on the HAT Website and the copyright and other intellectual property rights in that Content belong to or have been licensed by HAT, unless specifically labelled otherwise. All Content is protected by applicable United Kingdom and international intellectual property laws and treaties.
  • You may access, view, and use the HAT Website in a web browser and you may download the HAT Website (or any part of it) for caching purposes.
  • You may print one copy and download extracts of any page(s) from the HAT Website for personal use only.
  • You may not modify the printed copies or downloaded extracts in any way. Images, video, audio, or any other Content downloaded from the HAT Website must not be used separately from accompanying text.
  • HAT’s status as the owner and author of the Content on the HAT Website must always be acknowledged.
  • You may not use any Content saved or downloaded from the HAT Website for commercial purposes without first obtaining a licence from HAT. This does not prevent the normal access, viewing, and use of the HAT Website for general information purposes by business users or consumers.

Links to the HAT Website

  • You may link to any page on the HAT Website, provided that links are fair and lawful and do not take unfair advantage of or attempt to damage HAT’s reputation.
  • You must not link to the HAT Website in a manner that suggests any association with or endorsement from HAT where none exists.
  • Your link must not use any logos or trademarks displayed on the HAT Website without HAT’s express written permission.
  • You may not link to the HAT Website from a website whose main content is unlawful, obscene, offensive, defamatory, threatening, discriminatory, promotes violence or terrorism, infringes intellectual property rights, or is otherwise objectionable in HAT’s reasonable opinion.

Links to other websites may be included on the HAT Website. Unless expressly stated, these sites are not under HAT’s control. HAT accepts no responsibility or liability for the content of third-party websites. The inclusion of a link to another website is for information purposes only and does not imply any endorsement of that website or of its owners or operators.

Disclaimers

  • Nothing on the HAT Website constitutes professional advice on which you should rely. It is provided for general information purposes only.
  • HAT makes reasonable efforts to ensure that the Content on the HAT Website is complete, accurate, and up to date, but makes no warranties, representations, or guarantees (express or implied) that this will always be the case.
  • If you are a business user, HAT excludes all implied representations, warranties, conditions, and other terms that may apply to the HAT Website and Content.

HAT’s Liability

  • Nothing in these Terms and Conditions excludes or restricts HAT’s liability for fraud or fraudulent misrepresentation, for death or personal injury resulting from negligence, or for any other forms of liability which cannot be lawfully excluded or restricted.
  • If you are a business user, to the fullest extent permissible by law, HAT accepts no liability for any loss or damage, whether foreseeable or otherwise, in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the use of (or inability to use) the HAT Website or the use of or reliance upon any Content.
  • If you are a business user, HAT accepts no liability for loss of profit, sales, business, or revenue; loss of business opportunity, goodwill, or reputation; loss of anticipated savings; business interruption; or for any indirect or consequential loss or damage.
  • The HAT Website is intended for non-commercial use only. If you are a consumer, you agree that you will not use the HAT Website for any commercial or business purposes and that HAT shall have no liability to you for any business losses as set out above.
  • If you are a consumer and digital content from the HAT Website damages other digital content or a device belonging to you, where that damage is caused by HAT’s failure to use reasonable skill and care, HAT will either compensate you or repair the damage.
  • The right to compensation or repair in clause 13.5 will be lost if the damage could have been avoided by following advice or instructions from HAT or your software supplier, or if the minimum system requirements provided by HAT were not met.

Viruses, Malware, and Security

  • HAT exercises reasonable skill and care to ensure that the HAT Website is secure and free from viruses and malware; however, HAT does not guarantee that this is the case.
  • You are responsible for protecting your own hardware, software, data, and other material from viruses, malware, and other internet security risks.
  • You must not deliberately introduce viruses or other malware, or any other material which is malicious or technologically harmful, to or via the HAT Website.
  • You must not attempt to gain unauthorised access to any part of the HAT Website, the server on which it is stored, or any other server, computer, or database connected to the HAT Website.
  • You must not attack the HAT Website by means of a denial-of-service attack or by any other means.
  • By breaching clauses 14.3 to 14.5, you may be committing a criminal offence under the Computer Misuse Act 1990. Any such breaches will be reported to the relevant law enforcement authorities and HAT will cooperate fully, including by disclosing your identity. Your right to use the HAT Website will cease immediately in the event of such a breach.

Acceptable Use

  • You may only use the HAT Website in a lawful manner. You must ensure that you comply fully with any and all applicable local, national, or international laws and regulations.
  • You must not use the HAT Website in any way, or for any purpose, that is unlawful or fraudulent, or to knowingly send, upload, or transmit data that contains any form of virus or other malware.
  • If you fail to comply with this Part 15, HAT may take one or more of the following actions: suspend or terminate your right to use the HAT Website; issue a written warning; take legal proceedings against you for reimbursement of costs; disclose information to law enforcement authorities as required; or take any other actions HAT deems reasonably appropriate and lawful.
  • HAT excludes any and all liability arising out of any actions taken in response to a breach of this Part 15.

Your Personal Information

HAT will only use your personal information as set out in the Privacy Policy and the Cookie Policy.

Communications from HAT

  • If HAT has your contact details, HAT may send you important notices by email from time to time relating to matters including changes to the HAT Website or to these Terms and Conditions.
  • HAT will not send you marketing emails without your express consent. If you consent to marketing, you may opt out at any time. All marketing emails from HAT include an unsubscribe link. Please note that it may take up to three months for an opt-out request to take effect.
  • For questions or complaints about communications from HAT, please contact HAT using the details in Part 4.

Law and Jurisdiction

  • These Terms and Conditions, and the relationship between you and HAT, shall be governed by and construed in accordance with English law.
  • If you are a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in clause 18.1 takes away or reduces your legal rights as a consumer.
  • If you are a consumer, any dispute relating to these Terms and Conditions or to the relationship between you and HAT shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
  • If you are a business user, any dispute relating to these Terms and Conditions or to the relationship between you and HAT shall be subject to the exclusive jurisdiction of the courts of England and Wales.
